Terms and Conditions
Last updated: 10 June 2026
These Terms and Conditions ("Terms") govern your purchase and use of the Mac Performance Monitor application ("the App") provided by [Legal entity name] ("we", "us", "our"). By buying or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. The App
Mac Performance Monitor is a native macOS application that displays information about your Mac's performance. We may improve, change, or update the App from time to time.
2. License
When you buy the App you receive a personal, non-exclusive, non-transferable, perpetual license to install and use the App on Macs that you own or control. The license is for a one time purchase and does not expire.
You agree not to:
- copy, resell, sublicense, rent, or redistribute the App or your license key;
- reverse engineer, decompile, or disassemble the App, except where this restriction is not allowed by law;
- remove or alter any copyright or proprietary notices; or
- share your license key publicly or use it to circumvent the purchase of the App.
3. License keys
After a successful payment we issue a license key and send it to the email address associated with your order. Your license key is personal to you and acts as proof of your license. Please keep it safe. If you lose your key, you can request that it is sent to you again at the email address used for the original purchase.
4. Price and payment
The price of the App is shown on the buy page and is a one time charge. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment processing, billing, and the collection and remittance of applicable taxes such as VAT. Paddle's buyer terms apply to the purchase transaction in addition to these Terms.
5. Refunds
Because the App is a digital product that is made available to you immediately after purchase, refunds are handled on a case by case basis. If you have a problem with the App, please contact us first at [support email address] so we can try to help. Refund requests are processed through Paddle as the Merchant of Record. Nothing in these Terms affects any statutory rights you have as a consumer that cannot be excluded or limited by law.
6. Updates and support
We may release updates that fix issues or add functionality. We provide reasonable support by email at [support email address]. We do not guarantee that the App will be compatible with every future version of macOS or every hardware configuration.
7. Intellectual property
The App, including its code, design, and branding, is owned by [Legal entity name] and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. They grant you only the license described above.
8. Disclaimer
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error free, or that the performance information it shows will be accurate in all circumstances. You use the App at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of data, profit, or revenue, arising out of or in connection with your use of the App. Our total liability to you for any claim relating to the App will not exceed the amount you paid for it. Nothing in these Terms limits liability that cannot be limited by law.
10. Termination
Your license continues until terminated. We may terminate the license if you materially breach these Terms, for example by redistributing the App or sharing your license key. On termination you must stop using the App and delete all copies.
11. Privacy
We process the personal data needed to fulfil your order, such as your email address, so we can send your license key and provide support. Payment details are handled by Paddle and are not stored by us. A full privacy policy will be published on this site.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the App after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of [Country/jurisdiction], and the courts of [Country/jurisdiction] will have exclusive jurisdiction over any dispute, subject to any mandatory consumer protection rules that apply where you live.
14. Contact
If you have any questions about these Terms, contact us at [support email address].
